Si eu am de luat pentru mine si fiul meu câte 400,-€ de la TUfly.

Daca m-am descurcat fara avocati la Tarom :D cred ca pot si la TUIfly ... daca nu merge simplu atunci tot mai pot sa pun avocatii pe ei
Eu am primit de la TuiFly 400 euro/pax plus decontata o cazare pt un zbor amanat si a fost suficient sa fac plangerea din cont. Cam 14 zile a durat pana am primit raspunsul pe email si inca 3 zile pana au intrat banii.
Nu cred ca o sa apelezi la avocati :).

@ciprebbe la avocati nu, dar la organizatia non-profit germana care se ocupa de asemenea cazuri: Welcome - SÖP (nu costa nimica)

Dupa ce trecusera aproape 3 luni fara sa primesc vreun raspuns de la TUIfly am completat la ei cererea online si dupa 10 zile, voila:

Dear Mr Thomas,

with your conciliation request dated 21 September 2018 you have made a claim against the airline TUIfly GmbH amounting to 818.00 EUR. As previously communicated, we forwarded your request to the airline TUIfly GmbH.
TUIfly GmbH informed us that the claim is fully acknowledged without the recognition of a legal obligation. The airline TUIfly GmbH is willing to pay an amount of 818.00 EUR in total.
This settles the case without the need for a separate conciliation process due to the „immediate recognition“.
We would like to point out that this settlement between you and the airline TUIfly GmbH has been obtained as a quick resolution of the dispute without legal examination by the söp.
Further proceedings will now take place directly between you and the airline.
The airline will contact you or directly make the payment and therefore you do not have to take any further steps. Please note that this procedure may take a few weeks.

Ideea acestei asociatii mi se pare dealtfel extraordinar de buna:

German Conciliation Body for Public Transport (söp_Schlichtungsstelle für den öffentlichen Personenverkehr) was founded in December 2009 and handles disputes between travelers and transport companies for travel by train, bus, airplane or ship. Travelers can contact söp if they receive an unsatisfying response or none at all to complaints to the transport company. The conciliation request is then assessed and a settlement recommendation is made to resolve the dispute amicably and out of court. This saves money, time and trouble for all parties involved.

The söp is an independent and neutral organization that offers its service to customers of companies that participate in the söp conciliation. The process is free of charge for the customer; the cost is met by the transport companies.
RYR si WZZ sunt si ei membrii, BMS si ROT din pacate nu ... probabil ca ei stiu ca oricum foarte multi români nu îsi revendica drepturile ...

@tavi ideea în sine si de a realiza asa ceva sigur are legatura cu un anumit grad de civilizatie în societate, dar pâna la urma sunt si ratiuni pur economice din partea companiilor aeriene.

Cei care îsi cunosc si revendica drepturile în mod normal nu fac ca mine cu ROT (vezi: Drepturile pasagerilor ) când m-am pus si am mai scris o a doua revendicare cu argumente de genul "Cererea mea de compensatii am motivat-o cu Regulamentul EC261 cât si cu Hotărârea CJCE în cauzele conexate C-402/07 și C-432/07 ..." si facând o completa argumentatie juridica.

"Omul normal" care îsi cunoaste drepturile se adreseaza unui avocat sau acelor firme care se coupa contra cost de revendicari. Aceastea vor imputa companiilor aeriene nu doar compensatiile în sine prevazute de lege, ci si costurile proprii de asistenta. De regula acorda un termen destul de scurt pentru plata dupa care deschid procesul civil. Asta înseamna alte costuri de vreo 500-1.000,-€ pentru compania aeriana pe lânga despagubire.

Deci este în interesul companiilor de a crea o "cale de acces" de acest fel pentru pasagerii "insistenti" ;)
